Terms of Service
Last updated: August 17, 2026
These Terms of Service ("Terms") govern access to and use of Suhika's AI-assisted care team messaging platform (the "Service"), provided by Suhika ("Suhika," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you're using the Service on behalf of a clinic or practice, you're agreeing on that organization's behalf as well as your own.
1. Who these Terms apply to
The Service is used by two kinds of people, and these Terms apply a little differently to each:
- Doctors and clinic staff create an account to access the shared inbox, review AI-generated drafts, and manage patient conversations. These Terms govern that account and your use of the application directly.
- Patients interact with a clinic entirely over WhatsApp — no Suhika account is created or required. By messaging a clinic's WhatsApp number that uses Suhika, you agree that your messages will be processed as described in these Terms and our Privacy Policy.
Not a substitute for professional medical judgment. Suhika is a messaging and workflow tool. It does not practice medicine, diagnose conditions, or make treatment decisions. Every AI-generated response is reviewed by a licensed physician or clinic staff member before it reaches a patient — the treating doctor remains solely responsible for the clinical content of what's sent.
Not for emergencies. Suhika is not designed or intended for urgent or emergency medical situations. If you are experiencing a medical emergency, contact your local emergency services immediately — do not rely on a WhatsApp message to a clinic.
2. Description of the Service
Suhika helps doctors and clinic staff triage, route, and respond to patient messages received over WhatsApp. The Service classifies inbound messages, drafts suggested responses grounded in a patient's own record, and extracts structured information from uploaded prescriptions and diagnostic reports — all subject to human review before anything is sent to a patient. The Service is currently offered to a limited set of practices as we continue to develop it, and its features may change over time.
3. Accounts and eligibility
- Doctor and staff accounts must be created with accurate information and kept up to date.
- You're responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Accounts are intended for use by licensed healthcare professionals and authorized clinic staff acting within the scope of their role.
- You must notify us promptly of any unauthorized use of your account.
4. Doctor and clinic responsibilities
When using Suhika, doctors and clinic staff agree to:
- Review every AI-generated draft before it is sent — Suhika is designed to require this, but the responsibility for what's ultimately sent to a patient rests with the reviewing clinician.
- Ensure they have an appropriate basis (such as existing patient consent to be contacted over WhatsApp for their care) to message patients through the Service.
- Keep patient information accurate and promptly correct known errors in extracted or AI-drafted content.
- Comply with applicable healthcare, data protection, and telemedicine laws and professional obligations in their jurisdiction.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable healthcare or data protection regulations.
- Attempt to gain unauthorized access to another user's account, data, or patient records.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to send unsolicited bulk messages or content unrelated to a patient's care.
- Reverse-engineer, decompile, or attempt to extract the underlying models or source code of the Service.
6. AI-generated content
Suhika uses AI/large language models to classify messages, generate draft responses, and extract structured data from documents. AI-generated content may be incomplete, inaccurate, or fail to reflect a patient's full clinical picture. This is exactly why every draft requires human review before it is sent — no AI-generated content is delivered to a patient autonomously, and reviewing clinicians should treat drafts as a starting point, not a final answer.
7. Intellectual property
The Service, including its software, design, and branding, is owned by Suhika and protected by applicable intellectual property laws. Doctors and clinics retain ownership of their own patient data and records; using the Service does not transfer ownership of that data to us. We may use de-identified or aggregated data to maintain and improve the Service.
8. Fees
Pricing and billing terms, where applicable, will be communicated separately to clinics and practices before any fees apply. We'll provide notice before making material changes to pricing for an existing customer.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access to the Service, including for a breach of these Terms, misuse of the Service, or risk to patient safety, with notice where reasonably practicable. Certain provisions of these Terms — including those relating to intellectual property, disclaimers, and limitation of liability — survive termination.
10. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.
11. Limitation of liability
To the fullest extent permitted by law, Suhika will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law, including in connection with gross negligence or willful misconduct.
12. Governing law
These Terms are governed by the laws of India, without regard to its conflict of law principles. Any dispute arising out of these Terms will be subject to the exclusive jurisdiction of the courts of India.
13. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date above when we do, and where changes are material, we'll take reasonable steps to notify doctors and clinic staff with active accounts.
